Brazil court approves crypto seizure for debt collection. Creditors can now seize crypto assets from borrowers in Brazil. A Brazilian court has approved the seizure of cryptocurrencies for debt collection. The decision is made by the Third Panel of the Brazilian Superior Court of Justice (STJ). Through this process judges are authorized to retrieve crypto assets belonging to debtors who fail to pay their debts. The court decision represents an essential step to recognize digital currency as payment method and value stores. Brazilian Court Expands Debt Recovery Options to Include Crypto Assets Through the court ruling, creditors gained the power to petition judges to seize crypto assets of borrowers from their cryptocurrency brokers. The court made this decision after a creditor failed to obtain debtor assets following a legal victory in a court case. Through this ruling, cryptocurrency owners can use their digital assets in exactly the same way as other property assets to fulfill their debt payments. Previously, Brazilian courts could retrieve funds from bank accounts due to their BacenJud system partnership with the Central Bank of Brazil. Since cryptocurrencies operate outside the traditional banking industry their financial value posed a challenge to creditors who wanted to obtain them. The updated judicial order enables brokers to directly deliver crypto assets for debt repayment purposes. Brazilian Minister Villas Bôas Cueva expressed support for this decision given crypto assets behave as valuable financial assets, though Brazil has not declared them official monetary units yet. During his testimony, Minister Villas Bôas Cueva revealed pending legislation within Congress to define cryptocurrencies as financial assets for payment purposes. The regulatory recognition of cryptocurrencies by Brazil’s financial system would become stronger because of this measure.
