Regulations India may soon witness a major shift in how digital assets are governed, thanks to a pioneering model law introduced by Web3 incubator Hashed Emergent and policy think tank Black Dot. Dubbed the “COINS Act,” the initiative lays the groundwork for a modern crypto policy framework, blending user empowerment with regulatory clarity. Although not legally binding, the proposal seeks to influence India’s upcoming crypto regulation efforts by putting digital rights front and center. It aims to tackle ongoing industry roadblocks such as high taxation, ambiguous rules, and the lack of a dedicated regulatory body. At the heart of the COINS Act is the recognition of self-custody, code access, and financial privacy as fundamental digital freedoms. Rather than subjecting decentralized protocols to traditional oversight, the law calls for the creation of CARA—a crypto-specific regulator focused solely on services operating within India’s borders. The Act also introduces a dual approach to compliance: centralized services would require full licensing, while decentralized or non-custodial projects would operate under light or no regulatory burdens. A time-limited safe harbor for Indian token launches is also part of the plan, offering startups a regulatory breather during their first two years. Other highlights include a pause on certain foreign exchange rules to promote innovation and a proposed national crypto reserve—potentially including Bitcoin—to enhance India’s digital sovereignty. Developers would also gain protection from legal liability related to how others use their code.
